Q: What are the new laws in regards to child restraints?
A: All children under seven years of age must be secured in a child restraint or booster seat when traveling in a vehicle.
- Babies up to 6 month of age must be restrained in a rearward facing restraints.
- Children from 6 months to 4 years of age must be restrained in a rearward facing or forward facing restraint.
- From 4 years to 7 years of age a forward facing restraint or booster seat must be used.

Q: When do the laws come into effect?

A: In NSW the new laws came into effect on 1st March 2010

Q: Can I use a child restraint that was bought overseas?
A: No. Child restraints must comply with the Australian Standard. Restraints bought overseas (other than New Zealand) do not comply with our standard. Consumers should be wary of purchasing child restraints from online auction websites or online stores as these may not be comply with Australian standards.

Q: Who is responsible for ensuring a child is restrained in an approved restraints?
A: Motor Vehicle drivers are responsible for ensuring all children aged under seven years of age are restrained in appropriate, standard approved restraints.
Penalties apply for failing to ensure all children are appropriately restrained are: $253.00 and three demerit points (six demerit points during double demerit point periods) for each unrestrained or incorrectly restrained child.
